Judicialização da Saúde e Efetivação dos Direitos Fundamentais Sociais

Resumo

O presente artigo traz à reflexão o fenômeno da judicialização da saúde no Brasil, com ênfase em sua correlação com a efetivação dos direitos fundamentais sociais, em especial o direito à saúde, consagrado no artigo 196 da Constituição Federal. A crescente judicialização reflete a ineficácia das políticas públicas de saúde, gerando um cenário no qual o Poder Judiciário assume um papel decisório na materialização de direitos prestacionais. Todavia, essa intervenção judicial provoca tensionamentos com o princípio da reserva do possível e a alocação orçamentária do Estado. A pesquisa propõe soluções que conciliam a judicialização com a gestão racional de recursos públicos, a fim de garantir a eficácia dos direitos sociais sem comprometer a sustentabilidade do sistema de saúde.

Abstract

This article reflects on the phenomenon of the judicialization of health in Brazil, with an emphasis on its correlation with the realization of fundamental social rights, particularly the right to health, enshrined in Article 196 of the Federal Constitution. The growing trend of judicialization highlights the inefficacy of public health policies, creating a scenario in which the Judiciary assumes a decisive role in the enforcement of positive rights. However, such judicial intervention gives rise to tensions involving the principle of the reserve of the possible and the State’s budgetary allocation. This research proposes solutions that seek to reconcile judicialization with the rational management of public resources, in order to ensure the effectiveness of social rights without compromising the sustainability of the healthcare system.
